Who Has Legal Responsibility?

Role Your Responsibility
Commercial Duty Holders Must identify and manage all asbestos-containing materials in occupied non-domestic premises. This includes maintaining an asbestos register, an asbestos management plan, and ensuring staff are informed of risks.
Residential Landlords (Communal) Must manage risks in shared areas (hallways, stairwells, roof spaces) of residential buildings. A Management Survey is typically required for communal areas built before 2000.
Contractors & Project Clients Must obtain a Refurbishment & Demolition Survey before any building work on structures built before 2000. This ensures all asbestos is identified before disturbance.
Homeowners (Domestic) No legal duty for daily living. However, surveys are strongly recommended before renovation work or if suspect materials are in poor condition, to protect occupants.
